Terms of Use

The agreement between you and us about playing Cat & Seek — including what happens with purchases, XP and your account.

The agreement

These terms are between you and Uttapal Sangwan, trading as vickydarlinn (“we”, “us”), the publisher of Cat & Seek. By installing or playing Cat & Seek you accept them. If you do not, please do not use the app.

Our Privacy Policy is part of this agreement and explains what we do with your data.

Who can use it

You must be 13 or older to use Cat & Seek. If you are under the age of majority where you live, you may only use it with a parent’s or guardian’s permission, and they accept these terms with you.

Cat & Seek is a puzzle game for personal, non-commercial enjoyment. We give you a personal, non-transferable, revocable licence to use it on devices you own or control.

Your account

You can play as a guest with no account at all, or sign in with Google or Apple.

A guest account lives on one device and is held together by a credential the app stores there. If you delete the app, reset the device, or lose it, that credential is gone and the progress attached to it cannot be recovered by anyone, including us — a guest account has no email, so there is nothing to prove it was yours. Signing in is what makes progress portable.

You are responsible for what happens under your account. Tell us at vickydarlinn@gmail.com if you think someone else is using it.

Fair play

Please do not:

  • try to break into, overload, probe or reverse-engineer the app or our servers;
  • change or fake what the app sends us in order to claim a level, a streak or XP you did not earn;
  • use bots, scripts or automation to play;
  • tap ads you have no interest in, or fake watching an ad, to earn XP;
  • resell, rent out or redistribute the app or its levels;
  • use the app in any way that breaks the law where you are.

The server, not the app, decides whether a level is cleared and what you have earned. Attempts to change that will end the account.

XP and hints

XP is a number inside the game. You earn it by clearing levels and, from version 1.1, by choosing to watch a rewarded ad. You spend it on hints.

A rewarded ad adds XP only when our server records the claim. There is a daily limit on how many ads can add XP. Sometimes there is no ad to show, and an ad that fails or is closed early adds nothing.

XP is not money. It has no cash value, it cannot be exchanged for money or anything outside Cat & Seek, it cannot be transferred to another player or another account, and it disappears when the account is deleted. We may change how much XP a level or an ad awards, or a hint costs, as we tune the game.

Ads

From version 1.1, Cat & Seek is free to play and paid for by ads. It shows a banner, a full-screen ad now and then between levels, and ads you can choose to watch for XP.

The ads come from Google and the advertisers it works with, not from us. We do not endorse what they advertise, and tapping an ad may take you out of the app. What data ads use, and how to limit it, is in our Privacy Policy.

Purchases

Nothing in Cat & Seek can be bought today. There is no subscription, no XP pack and no other purchase available: the purchase system exists in the app but has no store credentials, so no payment can be taken and no purchase can be made or restored. If you find something in the app that looks purchasable, it will not complete.

The rest of this section is the agreement that will apply when, and only when, purchases are switched on. We will update the date on this page when that happens.

We do not publish a price here

Apple sets the price of everything in Cat & Seek separately for each country’s store, so there is no single figure that would be true for everyone reading this page. Any price printed here would be wrong somewhere.

So: the price you are shown in the app, in your own currency, immediately before you confirm is the price that applies — to that purchase, and to every renewal of it. Nothing on this website, and nothing in the app’s own text, states an amount; the store does.

Cat & Seek Pro — an auto-renewing subscription

  • What it is: Cat & Seek Pro, the only subscription we offer. There is no other paid tier.
  • What each period gives you: an XP top-up, added to your balance when the subscription starts and again on every renewal, and no banner or full-screen ads. The XP amount is shown on the Pro screen in the app before you buy — we may change it as we tune the game, and it is the same amount whatever the subscription costs where you live. Ads you choose to watch for XP stay available to you if you want them.
  • Length: one month. It renews every month until you cancel.
  • What it costs: the price shown in the app before you confirm — see We do not publish a price here, above.
  • How you pay: payment is charged to your Apple ID account when you confirm the purchase.
  • Renewal: the subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
  • Managing it: you can manage the subscription and turn off auto-renewal in your Apple ID account settings at any time after purchase. Deleting the app does not cancel a subscription.
  • Cancelling: turning off auto-renewal stops the next charge. The current period is not cancelled and is not refunded.
  • Free trial, if one is offered: any unused part of a free trial is forfeited when you buy a subscription.

XP packs

XP packs are consumables: a one-off purchase that adds XP to your balance immediately.

  • They come in several sizes. How much XP a pack adds, and what it costs, are both shown in the app before you buy — for the reason above, neither is printed here.
  • They are used up as you spend the XP, and they cannot be restored to a new device or a new account — that is what “consumable” means in the App Store.
  • They are not refundable by us, have no cash value, and cannot be transferred or exchanged.
  • Deleting your account destroys any XP balance, bought or earned.

Refunds

Purchases are made through Apple, not through us, so refunds are handled by Apple under its own terms. Ask Apple through reportaproblem.apple.com. We can help you work out what happened, but we cannot issue a refund for a store purchase ourselves.

The app will change

Cat & Seek is a live game. We add, change, retire and re-order levels; we tune difficulty, XP and hint costs; and we change or remove features. We may do this without notice. We will not take away a level you have already cleared, but we may change how it plays for everyone.

Our content, and yours

The app, the levels, the artwork, the name and the cat are ours or our licensors’. Nothing in these terms transfers any of that to you.

The only content you provide is a display name and a username. You confirm you have the right to use them, and that they are not offensive, misleading, or somebody else’s. We may remove either, or the account, if they are not.

No warranty

Cat & Seek is provided “as is”. We do our best to keep it working and to keep your progress safe, but we do not promise it will be uninterrupted, error-free, or available in every country, on every device, or at any particular time. To the extent the law allows, we exclude all implied warranties.

What we are responsible for

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Beyond that, and to the extent the law allows: we are not liable for indirect or consequential loss, for lost progress, lost XP or lost streaks, or for loss caused by something outside our reasonable control. Where liability cannot be excluded, it is limited to the greater of the amount you paid us for Cat & Seek in the twelve months before the claim, or ₹5,000 INR.

Some countries do not allow these exclusions. If yours does not, they do not apply to you.

Ending it

You can stop at any time: delete the app, or delete your account — see Deleting your account.

We can suspend or end your access if you break these terms, if we have to for legal reasons, or if we retire the app. If we retire Cat & Seek entirely, we will say so in the app first where we reasonably can.

Apple

Apple is not a party to these terms and has no obligation to support Cat & Seek. If the app fails to conform to any warranty Apple cannot disclaim, you may notify Apple and Apple will refund the purchase price of the app, if any; beyond that Apple has no other warranty obligation. Apple is a third-party beneficiary of these terms and may enforce them against you.

You confirm you are not in a country subject to a US Government embargo or listed as a prohibited party, as Apple’s own terms require.

Governing law

These terms are governed by the law of the courts of Delhi, India, and disputes go to the courts there. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in.

Changes to these terms

We may update these terms. The date at the top of this page changes when we do, and we will tell you in the app if the change is significant. Continuing to play after that means you accept the new terms.
